Export Controls on Superhard Materials, Related Items from China's Commerce Ministry, Customs

On October 9, the Ministry of Commerce (MOFCOM), in conjunction with the General Administration of Customs of China (GACC), issued an announcement regarding the implementation of export control measures on certain superhard materials, which will take effect on November 8, 2025.
With the approval of the State Council, it has been decided to impose export controls on the following items:
1.Synthetic diamond micro powder (average particle size ≤ 50 μm; reference tariff code: 71051020)
2.Synthetic diamond single crystal (average particle size > 50 μm and ≤ 500 μm; excluding lab-grown diamonds for decorative or jewelry use; reference tariff code: 71051020)
3.Synthetic diamond wire saw (wire diameter ≤ 45 μm, diamond particle size ≤ 8 μm, breaking tensile strength ≤ 16 N)
4.Synthetic diamond grinding wheel (hardness ≤ 30 HRB, diamond particle size ≤ 5 μm, operating speed ≥ 40 m/s; reference tariff code: 68042110)
5.Direct Current Plasma Chemical Vapor Deposition (DCPCVD) equipment (reference tariff code: 84798999)
6.2E902 DCPCVD process technology operators
Exporting the above-listed items shall comply with the relevant provisions of the Export Control Law of the People’s Republic of China and the Regulations of the People’s Republic of China on the Export Control of Dual-Use Items, and exporters must apply for a license from the competent department of commerce under the State Council.
Export operators shall be responsible for the authenticity of the declared goods and strengthen the identification of export items.
For controlled items, the customs declaration form must include the remark “Dual-use Item” and specify the corresponding export control code.
For items that are not controlled but have parameters, specifications, or performance close to the controlled thresholds, the declaration form must include the remark “Not a controlled item” along with detailed parameters and specifications.
If the information provided is incomplete, inaccurate, or deemed questionable in authenticity, the customs authorities will raise an official query, during which the export of the goods will be suspended until clarification is provided.
This announcement shall come into effect on November 8, 2025.
